Act 5
Tony sat on the rim of the water tower just inside the fence. He kept an eye pinned to Maggie through a sniper scope as she made her way around the sedan and slipped into the warehouse. He saw someone just inside the door and tensed slightly. Reaching his hand up to his earpiece, he made his report.
“She’s inside, Boss.”
“Watch through the window. McGee and I will move into position. Let us know when to move.”
The Italian said nothing as he shifted his sight to the window to the right of the door. His partner was now standing in clear view and he could see her profile from here. He hated that he was stuck up here as surveillance instead of on the ground with his Sig drawn and ready. If anyone had asked him, before Maggie had entered the picture, if he would ever feel the same way about a partner as he had about Kate, he would have said no. Now that Maggie had come back into his life and on to the team, he knew he would always have her back. She was his partner, just like Kate had been. This was a woman who was so much like his sister, that he couldn’t stand to be so far from her that he couldn’t get to her if something happened.
He had once told Kate that he had never had a sister, well that wasn’t entirely true. In the beginning, that was the exact relationship that he and Maggie had. He had been a big brother, and she had been his little sister. But then things had changed, and before Tony had been given the chance to sort out the feelings, she was gone and he had been left alone. And then there was Kate, who had rankled him like no other woman had in a long time. Not since Maggie had he felt so relaxed. But then Ari took Kate away and he was back to square one. Now he had Maggie back, but it wasn’t the same Maggie, and this made him sad and angry at times, but he was determined that this time, he would get it right. He would try his hardest to make her see, that he was the same old Tony that he used to be. And hopefully, the old Maggie would come back to him.
Inside, Maggie got a good look at the man she was to meet. Tony’s sketch had been a carbon copy of this man who was glaring uncertainly out of the crack of the door. At full height, he was as tall as Tony and his dark hair held a slightly greasy quality to it. He wore loose fitting clothes and his scruffy five o’clock shadow gave him a sleazy air. The Special Agent cocked her right hip, throwing her left foot forward, and after crossing her arms across her chest, glared at him. She put on an air of disdain as she regarded him shrewdly.
“So, you’re the guy I’m supposed to meet?” she snarked.
“Are you Maggie?” he queried back.
“Yea, I’m Maggie.”
“I’ve got what you ordered. Where’s the money?”
She reached out for the bag she had set on the table beside her, and tossed it just shy of his feet. He went to pick it up, but she stopped him with a grunt.
“Where’s my stuff?” she asked.
He made no reply, but simply moved over to a stack of boxes and pulled a suitcase from behind them. He walked back to her and handed it over. As she put it on the table he knelt by the bag and unzipped it.
Tony watched from his vantage point as Maggie opened the case, using the top of the case to conceal the high sign she flashed her partner. She never took her eyes from the suspect, but she knew that Tony had seen her.
“Boss, she’s ready.”
“Then get your ass down here and let’s go.”
Tony didn’t need to be told twice as he slid down the ladder, dropped the scope in his pack and pulled his Sig Sauer out of its holster under his arm. He stealthily made his way to the front door of the warehouse and held himself ready. Much as he wanted to rush in to Maggie’s side, he knew that to do so could put her in danger. Instead, he waited for the next signal from his partner. He could hear Gibbs over his earpiece.
“DiNozzo, you have the front, McGee and I have the inside rear. We wait until Sauer is at the door before we move. Copy that?”
“Copy that, Boss.”
“Copy, Boss,” answered McGee. Tony had to marvel once again at how much Tim McGee had grown in the year since Kate’s death. She would have been proud of the way he was turning out.
The three agents waited for their fourth to make the final move. Gibbs and McGee were crouched behind a stack of crates inside, while Tony back against the wall outside. Maggie had finished inspecting the merchandise and was waiting for Dunlay to finish his count. She stood tapping her foot lightly until he stood and smiled at her.
“It’s all there.” He smiled as her.
“Of course it is. What did you think; that I would cheat you?” She sniffed in disdain as she lifted the case and headed for the door. Behind the crates, Gibbs watched her and signaled to McGee, who tensed slightly. The marine was about to give Tony a signal when Dunlay looked up at Maggie and noticed her edging for the door, case in hand.
“So, who told you to call me?”
Maggie froze and behind the crates, Gibbs groaned inwardly. They all knew that she hadn’t taken her Glock 21 to the meeting and he had to get her out of there quickly. If anything happened to her, Gibbs knew in the back of his mind that Tony would kill the suspect before he could be stopped.
“DiNozzo, she’s going to need a quick exit.”
Outside, Tony couldn’t see what Gibbs saw, but he put his free hand on the door handle and prepared himself. His entire attention had shifted to a rescue of his partner. He waited impatiently for Gibbs to give him the go-ahead.
“You still haven’t answered me.” Dunlay took a step towards her, pulling a switch-blade from his pocket and flicking it open. “Who sent you?”
“NCIS, Freeze!” Gibbs scrambled from his place, gun at the ready. McGee was right behind him. Maggie attempted to get to the door, but Dunlay snagged her arm and spun her around, holding the knife in front of her face.
“Stay back; or I’ll gut her like a fish!”
Maggie’s eyes went wide for all of a second, and then she looked into Gibbs’ own eyes and instantly found herself calm. The Boss would get her out of this; she simply had to trust her team. Dunlay turned her to face the door.
“Now we are going to walk out of here and you aren’t gonna stop us. I’ll cut her if you do anything stupid.”
Gibbs glared at the man, but nodded slightly. He kept his Sig trained at Dunlay’s head. McGee took a small step to the right to get an angle on the man’s shoulder. Maggie reached to open the door, then moved slightly, trying to loosen Dunlay’s grip.
“You’re choking me, Damnit!” she hissed. He loosened his grip in reply and she turned the knob on the door. Dunlay kept his eyes on Gibbs, who was moving to the left, so the man didn’t see Tony on the other side of the door.
The agent wasted no time in snagging his partner’s arm and spinning her out of Dunlay’s grasp, narrowly missing the knife. The next thing their suspect knew, Tony’s Sig was under his chin and his green eyes were blazing before Dunlay’s own.
“That was the wrong agent to take hostage, Buddy,” Tony growled as Gibbs stepped up to take the man into custody.

As the team walked into the bullpen, they were greeted by a very exuberant Abby. McGee walked up to her and pulled her into a crushing hug.
“We got him, Abs.”
Maggie stood near her desk and heaved a large sigh. Abby’s evidence would put Mark Dunlay away for the death of his latest driver, David Sloan. The reason had been that Sloan had tried to skim more from the take into his own pocket and Dunlay had argued with him over it. The argument had resulted in the scuffle that Abby had been witness to.
Tony watched as his partner sat at her desk, When did I start thinking of it as her desk and not Kate’s?, and pull out a compact mirror to inspect her face. That knife had been quite close to her cheek and Tony shivered slightly as he remembered his shock upon seeing it when the door opened. He walked around and knelt down beside her, staring into the mirror with her.
“I don’t think it got you,” he whispered in her ear. She turned to look back at him as he smiled at her. She graced him with one of her rare looks of concern before reaching out to squeeze his hand.
“He could have gotten me.”
“You still would have been beautiful. Just as you are now.” He squeezed her hand in return before looking back at McGee and Abby as they held each other in the middle of the bullpen.
Gibbs had gone to report to the Director and prepare for the locals to take the case from him. Now that everything was complete, he wasn’t so opposed to giving the case to the “Proper” agencies. Now that his team was safe, he felt he could let the rest slip from his shoulders. And when did I start letting these emotions slip out to the surface? Not since Kate, I’m sure. I was still tough as nails during this last year. More so, in fact, than I had been before. He glanced over the railing at Tony kneeling next to Maggie. Yes, that would have to be when it happened. She wasn’t Kate; she was something different, better maybe.
Downstairs, Maggie gazed at Tony and debated with herself internally. Eventually she touched his shoulder.
“DiNozzo,” she began.
He turned to her and noticed the serious look on her face. He matched her seriousness and politely waited for her to continue.
“I’ve been thinking and… well, I don’t have a problem with you calling me Maggie… if you want to.”
His smile grew wide when she had finished speaking. She smiled back at him slightly.
“Maggie…” he seemed to be trying it out as if it had a taste. “Maggie… Mags… Maggie Pi-!”
She reached out and silenced him with a finger to his lips. “Maggie or Mags will be fine,” she reiterated.
That was fine. He knew in the back of his mind that he would break her soon enough. He went back to his desk and checked his search again. It was coming up empty in that it showed nothing new besides her service record, and that discouraged him slightly, but not enough to make him give up entirely. There was something that had happened to his friend. And he would use all the investigative skills he had acquired over the years to find out what it was. He owed it to her.

Ok, that is all I have done so far, I have one episode in Beta and I have two more eps that HAVE been Betaed that are waiting for the first one. You see where I am going with this? I'm stuck in a waiting game, which is why I wrote the TATE. I am now working on a Post-Twilight TATE that I intend to drop in Live Journal today, wish me luck!

Ok, I have found that this is getting too long and I didn't intend for it to do so. So this thread and the next ones to follow, will become update threads. BTW, I got a review today for "Filling the Void" in which the person said that the Character of Maggie was a sucky character with no redeeming qualities and basically a toned down Mary Sue. Oh well, to each their own, but since this person hasn't written her own fic for NCIS yet, I'm not going to let it get to me.... if I can help it that is...

I wouldn't agree with that review, Karie. Yes, it's hard to write original characters that are not at all Mary Sues, but I find her believable.
